Terms of service
General Terms and Conditions for Business Customers
1. Provider and scope
These General Terms and Conditions apply to orders placed through the online shop sevenfivezero.de with:
Axel Kirchhof, trading as SevenFiveZero
Peterstr. 5
63263 Neu-Isenburg
Germany
Our offer is intended exclusively for businesses within the meaning of section 14 of the German Civil Code (BGB) acting in the course of their commercial or independent professional activities when placing an order. We do not sell to consumers through this shop.
Individual agreements take precedence over these Terms and Conditions.
2. B2B account
A B2B account approved by us is required to make purchases. We may request suitable evidence of business activity.
The company, billing and contact details provided must be complete and accurate. Changes must be communicated promptly. Login details may only be made available to persons authorised to place orders for the respective business.
3. Orders and conclusion of contract
The presentation of products in the online shop is an invitation to place an order. By submitting an order, the customer makes a binding offer to purchase.
The contract is concluded when we expressly confirm the order, request payment or dispatch the goods, whichever occurs first. An automated email that merely confirms receipt of the order does not constitute acceptance.
The customer can correct input errors before submitting the order using the functions provided in the checkout.
4. Products, measurements and custom options
The product description and selected variant agreed at the time of concluding the contract are decisive.
Our jewellery is handmade. Measurements marked as ‘approx.’ are approximate. Minor variations resulting from the handcrafted process are possible, provided they do not impair the agreed suitability or quality.
Natural stones may vary in colour, pattern, inclusions and shape. The agreed characteristics remain binding.
For numbered Unique options, the selected variant number refers to the correspondingly numbered piece shown in the product image.
For custom-made items, the individually agreed characteristics, prices and delivery times also apply.
5. Prices and payment
Prices shown in the approved-access B2B shop are net prices in euros. Applicable VAT and any shipping costs are added. The amounts applicable to the order are displayed before the order is completed.
The payment methods offered at checkout and the payment terms stated there apply. Different payment terms require an individual agreement.
Deliveries outside the European Union may be subject to additional import duties and fees. Responsibility for these costs is determined by the delivery terms agreed for the order.
6. Delivery
We deliver to the shipping address provided with the order. Delivery areas, shipping costs and delivery times are determined by the information in the shop or by an individual agreement.
We will inform the customer of foreseeable delivery delays. Statutory rights relating to non-delivery or late delivery remain unaffected.
7. No consumer right of withdrawal and no voluntary returns
Orders placed in a business capacity are not subject to the statutory consumer right of withdrawal.
After dispatch, there is no voluntary right to return or exchange defect-free goods. Requests for changes or cancellation before dispatch require our approval.
Statutory rights relating to defects or other breaches of contract, and claims under our manufacturing warranty, remain unaffected.
8. Defects and complaints
Statutory rights relating to defects apply.
If the purchase is a commercial transaction for both parties, the statutory duties to inspect and give notice of defects under section 377 of the German Commercial Code (HGB) apply.
Please notify us of complaints, where possible including the order or invoice number and a description of the defect. Photos help us assess the issue. Please coordinate returns with us; statutory rights are not made conditional on prior return authorisation.
9. Voluntary manufacturing warranty
In addition to statutory rights relating to defects, we provide a lifetime warranty against manufacturing defects in SevenFiveZero jewellery.
The scope, eligibility and procedure are set out in the terms provided at the time of concluding the contract on our ‘Returns & lifetime manufacturing warranty’ page.
10. Liability
Statutory provisions apply to claims for damages. These Terms and Conditions do not impose any additional limitation of statutory liability.
11. Governing law
The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG). Mandatory statutory provisions remain unaffected.
